In these booking conditions, “you” and “your” means all members of the holiday party (including anyone added to or replaced at a later date) “We” “us” and “our” means Listers Leisure Ltd, Street Farm Hart Rhydding Lane, Addingham Moorside, Addingham, LS29 0QH. Olicana Cottages and Olicana Park are trading names of Listers Leisure Ltd and we may use these in these terms to refer to us.
- BEFORE BOOKING
Before booking with us, please read through these booking conditions carefully and if you have any questions, please contact us first. - THE CONTRACT
You can place a booking for a short term holiday rental of one of our cottages either via our website or over the telephone.
In order to place a booking with us, you must be 18 years of age or over. You must also provide us with the full list of the other members of your booking party including names, addresses and ages.
Once we receive your booking [and have received your deposit in cleared funds] we will confirm your booking [together with the booking fee,] with you in writing by post or by email where we have your email address.
Until we have confirmed your booking in writing there is no legally binding contract between us. We are under no obligation to accept your booking and if we don’t accept your booking we don’t have to give you a reason as to why we haven’t but we will normally give you a reason as to why we haven’t. This will usually be because the cottage has already been booked.
Once we have confirmed your booking there will be a legally binding contract between us and the contract will be subject to these booking conditions.
The contract will be subject to the law of England and Wales and any disputes arising from this contract will be dealt with solely in the English courts.
- PAYMENT
When you place a booking we normally ask for a deposit of £150 but we may, for longer rentals or for larger parties, ask for a larger deposit. We will let you know if this is the case.
The deposit must be paid within 5 days of you placing the booking and we will not confirm your booking until the deposit has been received.
The balance of the booking fee will be due for payment SIX WEEKS prior to the booking start date. If we have not received the outstanding balance then we reserve the right to cancel the booking.
If the booking is made within 6 WEEKS of the holiday start date the full amount of the booking fee will be required when making your booking otherwise we will not accept your booking.
You will not be allowed to enter any of the cottages or other properties until you have paid any outstanding booking fee balance in full.
Once we have accepted your booking, you are responsible for the booking fee in full even if you subsequently cancel, except as described in clause 4 below.
- CANCELLATION
If you want to cancel your booking you must inform us by telephone as soon as possible and then confirm this in writing by post or by email.If we are able to fill your cancelled booking slot then we will refund you the booking fee unless the booking fee for filling the cancelled booking is less than the booking fee you have paid, in which case we will only refund you the booking fee for filling the cancelled booking less a deduction for an administration fee.
If we are unable to fill your cancelled booking then you will not entitled to a refund under any circumstances and you will still be responsible for the booking fee in full as an administration fee.
We will also be entitled to charge you an administration fee for the costs that we incur for cancelling your booking. This fee will be a reasonable fee and reflects the time and effort spent as a result of your cancellation.
Please be aware that whilst we will try and fill your cancelled booking, we are under no obligation to do so.
- CANCELLATION INSURANCE
Cancellation Insurance is not compulsory but we strongly recommend such insurance to cover against the risk of having to pay the full booking fee should you have to cancel your booking. - CIRCUMSTANCES OUTSIDE OF OUR CONTROL/ACTS OF GOD
If for any reason we have to cancel your booking in advance due to circumstances beyond our control for example fire, flood, exceptional weather conditions, epidemics, destruction/damage to the property (“acts of god“) you will be refunded the full amount of the booking.
If we have to terminate your booking early because of an act of god, you will be refunded part of the booking fee based on the time remaining of the booking. No additional compensation, expenses or costs will be payable.
- PERIOD OF HIRE
Your holiday rental will be available from 3pm on the booking start date, and must be vacated by 10am on the booking end date. You must not use the property except for the purpose of a holiday during the rental period, and not for any other purpose or longer period.
The agreement to stay in the holiday rental for the rental period, does not create the relationship of Landlord and Tenant between the parties.
You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the Holiday Period.
- NUMBER OF PERSONS USING THE PROPERTY
The Olicana Cottages website clearly states the maximum number of occupants for each holiday let. You must not, under any circumstances, exceed the number of occupants in the holiday let. We reserve the right to refuse admittance if this condition is not observed or to ask you to leave the holiday let. If we do this then will treat you as if you have cancelled the booking.
Only members of your party may use the facilities at the holiday park.
YOU MUST NOT UNDER ANY CIRCUMSTANCES LEAVE CHILDREN ON THEIR OWN IN THE HOLIDAY LET.
- LIABILITY
Olicana Cottages, its employees and representatives shall not be liable to you or your party for loss or damage to personal belongings or vehicles howsoever arising. You must take all necessary steps to safeguard yourselves and your property. However we do not exclude or limit what we will be legally responsible for if death or personal injury is caused as a result of our negligence or that of our employees whilst acting in the course of their employment, or for any criminal act we may commit. - CARE OF THE PROPERTY AND BEHAVIOUR STANDARDS
You are responsible for the holiday let and are expected to take all reasonable care of its furniture, pictures, fittings and effects, in or on the holiday let.
You must leave the holiday let in the same state of repair, and in the same clean and tidy condition at the end of the rental period as at the beginning.
You must not use the holiday let for any dangerous, offensive, noxious, noisy, immoral activities or carry on there any act that may be a nuisance or annoyance to the owner or other neighbouring properties.
You must not act in a way that is likely to impair the enjoyment, comfort or health of other guests, residents, neighbours or members of staff or where you or any member of your party (or anyone invited into the holiday let by you) has broken the law, breached or is likely to breach any of these booking conditions,
We operate a strictly NO SMOKING Policy in all holiday lets.
Please also take the time to read the Olicana Folder at the start of your holiday as it contains important information about the holiday let.
- DAMAGES & BREAKAGES
You are responsible for and agree to reimburse us for all costs incurred by us for all damage or breakages or loss caused by you and/or members of your party and/or any other persons invited into the holiday let by you, to the holiday let or its contents, including without limitation the costs of replacement, repair or extra cleaning, on demand.
If you lose a key we will replace it upon you paying for the cutting of a new one.
You should inform us of any breakages as soon as possible so that we can take steps to replace them.
- WIFI
As part of your booking and stay at the holiday lets, we provide access to our onsite Wi-Fi.
You may use this Wi-Fi for things like browsing the internet and streaming services such as Netflix but you are not allowed to download illegal content or otherwise access illegal content. You agree not to use the Wi-Fi for any illegal or immoral purposes.
Please be aware that the Wi-Fi is provided as a courtesy. It is rural broadband and therefore has limitations that are outside of our control. We give no guarantees either to the availability or reliability of the Wi-Fi and if for any reason the Wi-Fi is not operational during your rental period then this will not give you a right to ask us for a refund or compensation.
- RIGHT OF ENTRY
We shall be allowed the right of entry to the holiday let at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance. - COMPLAINTS
We will make every effort to ensure that you have an enjoyable stay. However, if you have any problem or cause for complaint, please contact us immediately to give us the chance to resolve your issues. We value your custom and want you to return. - DATA PRIVACY STATEMENT
We will use your data only for the purposes of processing your booking and we will not use your data for any other reason without your express written consent. We agree to comply with all relevant data protection legislation and we will not sell your personal data to a third party.
